Control of COVID-19 Hazards
Face Coverings
FOX will provide new, clean, undamaged face coverings to employees and visitors, as required, and provide instruction on usage to help ensure they are properly worn. Measures will be in place to communicate face covering requirements to non-employees on FOX premises. Face coverings are available to all employees regardless of vaccination status. FOX will provide all employees with respiratory protection for voluntary use, upon request. Face shields are not a replacement for face coverings, although they may be worn together for additional protection.
FOX shall require face coverings and ensure they are properly worn when required by the California Department of Public Health (CDPH) or other Authority Having Jurisdiction (AHJ). FOX will not prevent any employee from wearing a face covering when not required by this section, unless it would create a safety hazard, such as interfering with the safe operation of equipment.
Shared tools, equipment and personal protective equipment (PPE)
PPE should not be shared, e.g., gloves, goggles, and face shields.
Items that employees come in regular physical contact with, such as phones, headsets, desks, keyboards, writing materials, instruments and tools must also not be shared, to the extent feasible. Where there must be sharing, the items will be cleaned or disinfected periodically by the individual using the shared item/equipment.
Work locations are reviewed to facilitate the placement of cleaning supplies in locations throughout the worksite for employee’s utilizing shared equipment. Locations are checked on a routine basis and supplies are re-filled on an ongoing basis.
Sharing of vehicles will be minimized to the extent feasible, and high-touch points (for example, steering wheel, door handles, seatbelt buckles, armrests, shifter, etc.) should be cleaned daily and prior to change in operators. Fox Corporation will follow the procedures in accordance with Attachment 4 : Fox Corporation Provided Transportation.
Hand sanitizing
In order to implement effective hand sanitizing procedures, Fox Corporation:
- Encourages employees to frequently wash their hands with soap and water for at least 20 seconds, including before and after eating, prior to returning to your workstation, after using the restroom, and after contacting high touch areas (i.e., door handles, copy machines, elevator buttons, etc.).
- Allows additional time for employees to wash their hands.
- Provides alcohol-based sanitizer (at least 60% alcohol) when you cannot use soap and water. Hand sanitizers that contain methanol are prohibited.
- Evaluates the need for handwashing facilities and deploys hand washing stations where necessary.
- Assesses locations occupied by employees to distribute and replace hand sanitizer at their worksite, as needed.
Personal protective equipment (PPE) used to control employees’ exposure to COVID-19
- The FOX EHS Department evaluates the need for PPE (such as gloves, goggles, and face shields) and provides such PPE as needed to department heads to distribute to their team.
- FOX has developed a comprehensive Respiratory Protection Program and is committed to minimizing the use of respiratory protection in favor of other exposure controls whenever possible. Respirators will be made available upon request for voluntary use in compliance with FOX’s Voluntary Respirator Use Program. Any intended voluntary use of a respirator associated with COVID-19 must be coordinated with the EHS Department prior to use.
- Employees working in a vehicle or working indoors with more than one person will be provided a respirator for voluntary use on request.
- To obtain a voluntary use respirator, employees must complete FOX’s voluntary respirator training located here.
- If employees purchase their own respirator, it is the employee’s responsibility to take precautions to be sure that the respirator itself does not present a hazard to themselves or other employees and is effective.
- Respirators that are equipped with an exhalation valve are not permitted for COVID-19 protection.
- Respirators designated as KN95 are not recognized as respiratory protection but can be considered a mask that can be worn in lieu of a cloth mask or surgical-type mask.
- Respiratory protection is evaluated in accordance with regulatory requirements and EHS 302 – Respiratory Protection Program.
Engineering controls
FOX has implemented the following measures, or combination of measures, to eliminate or reduce exposure(s) associated with COVID-19 hazards:
- Building enhancements including touchless fixtures (touchless soap dispensers and touchless paper towel dispensers) have been installed where practicable.
- Solid partitions such as plexi-glass have been installed in some locations.
- Antimicrobial door hardware has been assessed and installed, where feasible.
- Ultraviolet Radiation (UV-C), a germicidal disinfectant is utilized in strategic locations throughout FOX worksites.
- Use of dry hydrogen peroxide, a no touch disinfection technology, has been installed at some locations.
- We maximize, to the extent feasible, the quantity of outside air for our buildings with mechanical or natural ventilation systems by:
- Upgrading filtration efficiency to the highest level compatible with the existing ventilation systems. Our goal is to use minimum efficiency reporting value (MERV)-13 or higher efficiency filters on all ventilation systems that are compatible with the upgraded filtration.
- Evaluating indoor locations, to maximize the quantity of outdoor air ventilation to the extent feasible.
- Preventative maintenance and filtration changes are performed on an increased routine schedule.
- Decreasing occupancy in areas where outdoor ventilation cannot be increased.
- Increasing air flow to occupied spaces, where possible.
Cleaning and disinfecting
FOX provides routine cleaning and disinfecting. Cleaning practices are followed to maintain a safe working environment. High touch areas (such as common areas, elevators, pantries, restrooms, and doorknobs) are cleaned routinely with the provided Environmental Protection Agency (EPA) approved disinfectants. Those responsible for performing cleaning will adhere to the manufactures recommendations and any other guidance issued by public health authorities with respect to cleaning practices. Disinfectant products and cleaning locations are continuously being reviewed to enhance FOX’s cleaning protocols.
- Those responsible for performing cleaning will adhere to the following recommendations and any other guidance issued by public health authorities with respect to cleaning practices:
- High-touch surfaces in occupied common areas are wiped down periodically with an EPA approved disinfectant, following the disinfectant manufacturer’s instructions (e.g., safety requirements, protective equipment, concentration, and contact time). Examples of high- touch surfaces are tables, doorknobs, countertops, faucets, etc.
- Ensuring adequate supplies and time for disinfection to be completed properly.
- General housekeeping services (vacuum, dust, and trash) are performed on an increased frequency based on occupancy and usage.
- Workspaces are cleaned and disinfected with increased frequency, with an emphasis on high-touch surfaces.
- In some locations, FOX has implemented the use of an electrostatic cleaning and disinfection system or similar that provides effective and efficient cleaning.
- Minimized use of shared office equipment such as copiers and fax machines, whenever possible. When use of such equipment is unavoidable, hand hygiene and equipment disinfecting materials are provided for use.
- Ultraviolet Radiation (UV-C), a germicidal disinfectant is utilized in strategic locations throughout FOX worksites.
- FOX endeavors to inform our employees and authorized employee representatives of the frequency and scope of cleaning and disinfection. In some locations, FOX will update signage to communicate when the area(s) was last cleaned.
Known or suspected COVID-19 cases
- If FOX becomes aware of a COVID-19 case in the workplace, implementation of the following procedures is initiated. The procedure includes:
- Determining the affected area(s).
- Initiating the decontamination process. This includes cleaning of areas, material, and equipment used by a COVID-19 case during the infectious period, and cleaning the area, material, or equipment is indoors and will be used by another employee within 24 hours of the COVID-19 case.
- The areas identified will not be occupied until the decontamination process is complete.
- FOX utilizes third-party vendors (or janitorial staff) to complete this process. The individual(s) performing the cleaning work should be trained on the appropriate application as well as the hazards associated with the product and use of the correct PPE in accordance with the safety data sheet recommendations.
Investigating and Responding to COVID-19 Cases
- Contacted by their Human Resources Business Partner (HRBP) if they have been identified as having a workplace exposure through contract tracing to initiate their quarantine period. A workplace exposure (also called a close contact) is dependent on the size of an employer’s indoor space.
- For indoor spaces of 400,000 cubic feet or fewer, a close contact is someone who shares the same indoor airspace with a COVID-19 case for a cumulative total of 15 minutes or more over a 24-hour period during the COVID-19 case’s infectious period.
- For indoor airspaces of more than 400,000 cubic feet, a close contact is someone who is within six feet of a COVID-19 case for a cumulative total of 15 minutes or more over a 24-hour period during the COVID-19 case’s infectious period.
- An investigation is conducted, to determine who may have had close contact.
- If a close contact is identified, written notice will be communicated to people at the worksite who may have been exposed, such as employees, independent contractors, or their authorized representative within one business day of the time FOX knew of the COVID-19 case in a form readily understandable by employees. The written notice will not include any personal identifying information and the disinfection plan will be included.
- COVID-19 testing is available at no cost, during paid time to all the employees who had close contact in the workplace.
Additional information on COVID-19 isolation and quarantine guidelines for FOX employees can be found on OneFOX.
Injury and Illness Investigations
The EHS Department will investigate and keep records of all work related confirmed positive COVID-19 cases utilizing a recordkeeping management system. FOX employees must cooperate with injury and illness investigations conducted in response to a workplace exposure. After investigations are complete, the EHS Department is responsible for recordkeeping and reporting determinations for work relatedness regarding COVID-19 cases and assist in the identification of appropriate corrective actions to prevent similar exposures in the workplace.
FOX will record all required confirmed work related COVID-19 illnesses and report outbreaks, hospitalizations, and fatalities to the applicable federal, state and or local agency as soon as they are notified.
Responding to COVID-19 Outbreaks in the Workplace
In the event that there are three or more employee related COVID-19 cases in an exposed group within a 14-day period, or Fox Corporation has been identified as the location of an outbreak identified by the local health department, Fox Corporation will follow the procedures in accordance with Attachment 5: Responding to Outbreaks in the Workplace.
Training and Instruction
FOX will document and provide effective COVID-19 training and instruction that includes:
- Our COVID-19 policies and procedures to protect employees from COVID-19 hazards and how to participate in the identification and evaluation of COVID-19 hazards.
- Information regarding COVID-19-related benefits to which the employee may be entitled under applicable federal, state, or local laws. This includes any benefits available under legally mandated sick and vacation leave.
- Discussion about COVID-19 being an infectious disease that can be spread through the air when an infectious person talks or vocalizes, sneezes, coughs, or exhales.
- Transmission methods when a person touches a contaminated object and then touches their eyes, nose, or mouth.
- Preventing COVID-19 by communicating the effectiveness of the vaccine and how it protects against transmission and serious injury or death.
- How particles containing the virus can travel more than six feet, especially indoors, therefore, physical distancing, face coverings, increased ventilation indoors, and respiratory protection decrease the spread of COVID-19, but are most effective when used in combination.
- FOX’s policy for providing respirators, and the rights of employees to request a respirator for voluntary use without fear of retaliation and at no cost to the employee. When respirators are used for voluntary use, employees will be trained on how to properly wear the respirator provided and how to perform a seal check according to the manufacturer’s instructions each time a respirator is worn. This includes how facial hair can interfere with the seal.
- The importance of hand hygiene, including frequent hand washing with soap and water for at least 20 seconds and using hand sanitizer when employees do not have immediate access to a sink or hand washing facility. Hand sanitizer does not work if the hands are soiled.
- Proper use of face coverings and discuss face coverings not being respiratory protective equipment. N95s are more protective respirators. They protect the users from airborne disease while face coverings primarily protect people around the user.
- COVID-19 is an airborne disease and how an infectious person may have no symptoms.
- Information on the employer’s COVID-19 policies; how to access COVID-19 testing and vaccination; and facts on how vaccination is effective at preventing COVID-19, protecting against both transmission and serious illness or death.
- COVID-19 symptoms, testing and staying home if experiencing symptoms consistent with COVID-19 to stop the spread.
- The conditions under which face coverings must be worn at the workplace. Additionally, face coverings are recommended outdoors for people who are not fully vaccinated if six feet of distance between people cannot be maintained. Employees can request face coverings from the employer at no cost to the employee and can wear them at work, regardless of vaccination status, without fear of retaliation.
- Additional COVID-19 training may be offered to employees depending on the job type and location.
Exclusion of COVID-19 Cases
Measures to limit transmission when there is a COVID-19 case or employees who had close contact in the workplace include:
- Ensuring COVID-19 cases are excluded from the workplace until return-to-work requirements are met.
- Excluding employees with COVID-19 exposure from the workplace consistent with federal, state, and local guidance in correlation with CDC guidance.
- Continuing and maintaining an employee’s earnings, seniority, and all other employee rights and benefits whenever we have demonstrated that the COVID-19 exposure is work related.
- FOX’s Human Resources Business Partner will communicate benefits and employee rights while the employee is in isolation or quarantine.
- The FOX HR Department will perform wellness checks with the employee and FOX’s medical provider will clear them to return to work based on federal, local, and state quarantine/isolation requirements.
Reporting, Recordkeeping, and Access
It is our policy to:
- Report information about COVID-19 cases and outbreaks at our workplace to the local health department whenever required by law, and provide any related information requested by the local health department.
- Maintain records of the steps taken to implement the written COVID-19 Prevention Program for Fox Corporation.
- Make our written COVID-19 Prevention Program available at the workplace to employees, authorized employee representatives, and to representatives of OSHA or the local health authority immediately upon request.
- Investigate COVID-19 cases utilizing a recordkeeping management system to maintain a record of and track all workplace COVID-19 cases. The information will be made available to employees, authorized employee representatives, or as otherwise required by law, with personal identifying information removed.
Return-to-Work Criteria
COVID-19 cases, regardless of vaccination status, previous infection, lack of symptoms, or whose COVID-19 symptoms are resolving, shall not return to work until:
